a. Imploy shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, loss of profits, data, goodwill, or other intangible losses resulting from the use or inability to use the platform.

b. Imploy does not guarantee the accuracy, completeness, or usefulness of information and materials found on the platform. Users acknowledge that reliance on any such information is at their own risk.

c. Imploy is not responsible for any actions or omissions by its users, including but not limited to, employers, job seekers, or third parties.

Dispute Resolution:

a. In the event of any dispute, claim, or controversy arising out of or relating to the use of Imploy, both parties agree to first attempt to negotiate and resolve the matter informally.

b. If resolution is not reached through negotiation, both parties agree to proceed to mediation according to the rules of a mutually agreed-upon recognized mediation organization.

c. If mediation does not resolve the dispute, the dispute shall be referred to binding arbitration in accordance with the rules of an agreed-upon recognized arbitration body.

d. Any arbitration award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction over it.

e. This section does not prevent either party from seeking judicial relief in a competent court.

Non-payment: Failure to pay for premium services (if any).

Account Deletion: Users may request the deletion of their account at any time. Upon receiving a deletion request, we will deactivate the account and remove most of the data associated with the account.

This retained data will be anonymized and will not include any personally identifiable information, except where required by law.

The termination or suspension of a user’s account may be temporary or permanent, depending on the severity and recurrence of the violation. Imploy will notify and explain such actions to users whenever possible. Users have the right to appeal decisions related to account termination or suspension.

Changes to Terms

Governing Law

This agreement is subject to and interpreted in accordance with the laws of the Kingdom of Saudi Arabia, regardless of its conflict of law principles. Any disputes arising under or in connection with this agreement are subject to the exclusive jurisdiction of the courts located within the Kingdom of Saudi Arabia. Both parties consent to the jurisdiction and venue of these courts.

Severability

Should any provision or part of this agreement be found invalid or unenforceable under applicable law, it will not affect the validity or enforceability of the remaining provisions or parts of this agreement. Both parties agree to replace any unenforceable provision with a valid and enforceable provision that achieves the original economic, legal, and commercial objectives to the maximum extent possible.
